TERMS OF USE (aka "The Fine Print")

At Winebuys.com, what the big print giveth the fine print preserves. We want your shopping experience to be as pleasant and rewarding as possible. That is why, for example, we offer you the best values for the best premium wines with a no-questions-asked "We're not happy till you're happy" guarantee.

With all good things, however, come responsibilities, both on the part of Winebuys.com, and on the part of the customer or visitor to the Winebuys.com website. These responsibilities are set out in our Fine Print. So here goes:

Privacy

Our responsibility: Winebuys.com takes its customers' privacy very seriously. Any private information that you give us, remains with us, period (unless for some reason the law requires otherwise). We will not sell, rent, loan or otherwise allow any unaffiliated parties to use any of our customer information. Moreover, we consider our customer information to be uniquely our own, and will defend against anyone who tries to use it without proper authorization or for improper purposes.

Your responsibility: If you use the site, you promise to maintain the confidentiality of the information you provide us, including your user name and password, and to restrict access to your computer for this purpose. Winebuys.com cannot be responsible for any activities that are done in your name due to no fault of Winebuys.com.

Transaction Security

Winebuys.com uses secure server technology. All credit card information is encrypted and then verified.

All credit card purchases are authorized at the time of purchase, when you place your order. However, your credit card account will not be charged until your order is processed and shipped.

Warranties

As you may know already, Winebuys.com's "We're not happy till you're happy" guarantee makes shopping at Winebuys.com risk free. We make no other warrantees or representations of any kind. As such, Winebuys.com's sole and exclusive liability to you will not exceed the price of the product ordered, plus shipping costs.

Use of the Site

Naturally, you are free to wander around the Winebuys.com website and use the information you may glean for your own personal purposes or for any lawful purpose. In fact, we encourage it. We make every effort to make Winebuys.com as entertaining, informative and rewarding as possible.

In case you didn't know, however, this means that you cannot copy or modify any of the content on the pages, or use anything contained in or on the website for commercial purposes.

If Winebuys.com determines that any of your responsibilities were breached, it may refuse service, terminate your account, cancel orders, or take any other appropriate steps at its discretion.

Sales to Minors

Here again, the rules and responsibilities are simple. The nonalcoholic products at Winebuys.com are available to anyone over 18 with a valid credit card. However, we will not sell alcoholic beverages to anyone under 21 years old, no ifs, ands or buts. Our shipping policy in this regard is very carefully spelled out before you can place an order or check out.

While it is impossible to limit access to the web site by children under 18, no one under 13 years of age may sign up for any of our nonmerchandise activities, like newsletters or reminders, if any. Winebuys.com will not knowingly take any personal information from anyone under 13 years old. Winebuys.com urges parents and guardians to use the internet responsibly and to help your children determine which web sites are appropriate to visit.

Winebuys.com, the Winebuys.com logo, Winebuys Guy and the Winebuys Guy logo, are the trademarks of Winebuys.com, LLC.

Those of you who are inclined to profit wrongfully from Winebuys.com's intellectual property (and you know who you are) should not do so. This includes, for example but without limitation, using Winebuys.com's intellectual property for the purposes of resale; unfair competition; downloading or copying content for someone else's commercial use; as metatags or for data mining.

Winebuys.com will aggressively defend its intellectual property in order to assure that you, the customer, will not be misled or otherwise injured by the less scrupulous people out there. If you want to use any of Winebuys.com's intellectual property for any of the above prohibited uses, you must first get our written permission.

Any other trademarks, logos and intellectual property on Winebuys.com's website are the properties of the respective owners.

The Winebuys.com website may contain links to other sites. These links are provided for our customers' convenience and we hope they prove helpful. However, Winebuys.com cannot be responsible for the content of those web sites, or anything else outside of Winebuys.com's control.

Ownership of Goods

All products purchased from Winebuys.com are sold in Ferndale, Michigan, and are subject to the laws and regulations of the State of Michigan and the United States regarding purchase and shipping of wine. We reserve the right under all circumstances to set maximum order limits. Winebuys.com makes no legal representations to its customers regarding their right to purchase wine from Winebuys.com or to have it delivered outside of the State of Michigan.

As such, any product purchased from Winebuys.com becomes the property of the customer at the time of purchase. Should you chose to ship your purchase to a wine storage facility or other third party at an address other than your own home address, you agree that Winebuys.com cannot be responsible for your purchase after title changes hands.

Mistakes

We're only human, and try as we will to avoid them, we may make a mistake. We will always endeavor to honor any listed prices or products, but where it is impossible because of a typographical or other error, we reserve the right to withdraw the product or correct the price.

Dispute Resolution

We can't imagine any circumstance that could arise where anyone could possibly have a dispute with us. In the unlikely event that a dispute does arise, we will be happy to present the dispute for binding arbitration pursuant to the rules of the American Arbitration Association for determination in Michigan pursuant to Michigan law. By using the Winebuys.com website, you agree to use binding arbitration and to the jurisdiction and venue.
